DYNAMICANGLING TERMS AND CONDITIONS

These Terms and Conditions (“Terms”) govern your access to and use of the DynamicAngling mobile application available on Android and iOS platforms (the “App”).

By accessing, registering for, or using the App, you agree to be bound by these Terms and the DynamicAngling Privacy Policy. If you do not agree, you must not use the App.

1. About DynamicAngling

1.1 DynamicAngling is a social fishing application created by Johan Fick, an electronic engineer operating in the Republic of South Africa.

1.2 The App is designed to enable users to:

• locate and share fishing spots;interact and socialise with other anglers;share and access information relating to dams, fish species, equipment, lures, and fishing experiences; andparticipate in community-driven angling discussions and activities.

1.3 DynamicAngling provides a digital social platform only and does not offer professional, technical, environmental, safety, or legal advice.

2. Definitions and interpretation

2.1 In these Terms, unless the context indicates otherwise:

• “App” means the DynamicAngling mobile application.“DynamicAngling”, “we”, “us” or “our” means the operator of the App.“User”, “you” or “your” means any person who accesses or uses the App.“Content” means all information, posts, locations, data, text, images, and other material shared through the App.“User-Generated Content” means Content uploaded or shared by users.“Personal Information” has the meaning assigned in POPIA and the Privacy Policy.

3. Acceptance of Terms

3.1 These Terms constitute a legally binding agreement between you and DynamicAngling.

3.2 By using the App, you confirm that you:

• have read and understood these Terms;are legally competent to enter into this agreement; andagree to comply with all applicable laws.

4. Relationship with Privacy Policy

4.1 These Terms must be read together with the DynamicAngling Privacy Policy.

4.2 In the event of any inconsistency, the Privacy Policy prevails to the extent of Personal Information processing.

5. Eligibility and age restriction

5.1 The App is not intended for persons under the age of 13 years.

5.2 By using the App, you warrant that you meet this age requirement and have obtained any required consents.

6. User accounts

6.1 Certain features require account registration.

6.2 You agree to:

• provide accurate and complete information;keep your login credentials secure; andnotify DynamicAngling immediately of unauthorised account use.

6.3 You are responsible for all activity conducted through your account.

7. Acceptable use

7.1 You agree to use the App lawfully and respectfully.

7.2 You may not:

• post false, misleading, or harmful information;harass, threaten, or abuse other users;post unlawful, offensive, or inappropriate content;misuse fishing location data for unlawful purposes;interfere with the operation or security of the App.

7.3 DynamicAngling reserves the right to remove content or suspend accounts that breach these Terms.

8. User-generated content and community data

8.1 The App relies on community-contributed data, including fishing spots, equipment recommendations, and angling experiences.

8.2 DynamicAngling does not verify, guarantee, or warrant the accuracy, legality, safety, or suitability of any User-Generated Content.

8.3 You use fishing location data, equipment recommendations, and related information at your own risk.

8.4 You warrant that any content you post:

• is accurate to the best of your knowledge;does not infringe third-party rights; andcomplies with applicable laws and conservation regulations.

9. Environmental, safety, and legal compliance

9.1 You are solely responsible for:

• complying with fishing laws, permits, and regulations;respecting private property and access rights;ensuring your own safety and the safety of others;complying with environmental and conservation requirements.

9.2 DynamicAngling is not responsible for injuries, losses, fines, or damages arising from fishing activities or reliance on App content.

10. Intellectual property

10.1 All intellectual property rights in the App (excluding User-Generated Content) belong to DynamicAngling or its licensors.

10.2 By submitting content, you grant DynamicAngling a non-exclusive, royalty-free licence to use such content for App-related purposes.

11. Privacy and data protection

11.1 Personal Information is processed in accordance with POPIA and the DynamicAngling Privacy Policy.

12. Third-party services

12.1 The App may integrate with or link to third-party services.

12.2 DynamicAngling is not responsible for third-party platforms, content, or practices.

13. Suspension and termination

13.1 DynamicAngling may suspend or terminate access for:

• breach of these Terms;misuse of the App; orlegal or regulatory reasons.

13.2 Upon termination, your right to use the App ceases immediately.

14. Limitation of liability

14.1 To the extent permitted by law, DynamicAngling is not liable for:

• inaccuracies in fishing data or locations;reliance on User-Generated Content;loss, injury, or damage arising from fishing activities;indirect or consequential damages.

14.2 Nothing in these Terms limits rights under the Consumer Protection Act.

15. Indemnity

15.1 You indemnify DynamicAngling against any claim arising from:

• your use of the App;content you submit; orbreach of these Terms or applicable law.

16. Amendments

16.1 DynamicAngling may amend these Terms from time to time.

16.2 Continued use of the App constitutes acceptance of amended Terms.

17. Governing law and jurisdiction

17.1 These Terms are governed by the laws of the Republic of South Africa.

17.2 South African courts have jurisdiction, subject to the CPA.
